Tararua Landscapes Co. Terms and Conditions

These Tararua Inc. terms & conditions apply to the landscaping services provided by Tararua Landscapes Co. (“we”, “us” or “our”).


By accepting a quote, requesting that work commence, booking a service, entering a recurring service arrangement, or otherwise engaging us to perform landscaping services, you agree to the applicable terms listed below.


Nothing in these Tararua Inc. terms is intended to exclude or restrict rights or remedies that cannot lawfully be excluded under New Zealand law, including rights that may apply under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.


1. Services


We may provide landscaping services including:


- Lawn mowing and edging

- Lawn maintenance

- Weed control

- Fertilisation

- Lawn redevelopment

- Hedge and shrub trimming

- Garden maintenance and tidy-ups

- Green-waste removal

- Pressure washing

- Exterior washing

- Window cleaning

- Property maintenance

- Commercial cleaning

- Other services agreed with the customer


The exact scope of work will be determined by the quote, service agreement, invoice, booking confirmation, or other written agreement between us and the customer.


2. Quotes and Estimates


Unless stated otherwise, quotes for our landscaping services are based on the information and property conditions reasonably available to us when the quote is prepared. 


If the actual work differs materially from what was represented or reasonably visible when quoted, we may discuss additional work or charges with the customer before proceeding. 


Examples may include:


- Excessive or unexpected vegetation

- Hidden waste or debris

- Restricted access

- Unexpected disposal requirements

- Additional areas not included in the original scope

- Conditions materially different from those described by the customer


Acceptance of a quote may be made electronically, verbally, by requesting that work proceed, or through another method agreed between us and the customer.


3. Pricing


Prices for landscaping services may be stated as inclusive or exclusive of GST. The applicable quote, invoice, or service agreement will specify pricing where necessary.


Additional services requested outside the agreed scope may incur additional charges.


Where work is charged by time, the amount payable will be based on the applicable agreed rate and chargeable work performed.


4. Recurring Services


Customers may arrange recurring landscaping services such as regular lawn mowing or property maintenance. 


Frequency may vary depending on the agreed service arrangement, season, weather, property conditions, and growth rates.


Recurring service arrangements continue according to their applicable agreement until cancelled, expired, or otherwise terminated in accordance with the applicable terms.


5. Subscription or Property-Care Plans


Where a customer purchases a subscription or property-care plan, the inclusions, service frequency, priority level, complementary service allowance, and other benefits will be those specified for that plan at the time of purchase.


Benefits:


- Are for the subscribed customer/property unless otherwise stated

- Cannot ordinarily be exchanged for cash

- May be subject to reasonable booking availability

- Must be used within the applicable plan period unless otherwise stated


Any services outside the plan’s inclusions may be quoted or charged separately.


6. Property Access


Customers are responsible for providing safe and reasonable access to areas where landscaping services are required. 


This includes, where applicable:


- Unlocking gates

- Providing access instructions

- Moving vehicles where necessary

- Ensuring inaccessible areas are made available

- Advising us of access restrictions


If we cannot reasonably perform the scheduled work because access has not been provided, the visit may be rescheduled and a reasonable call-out or cancellation charge may apply where disclosed or agreed.


7. Pets and Animals


Customers must take reasonable steps to ensure pets and animals do not interfere with work or create a safety risk. 


Where necessary, animals should be securely contained while work is being performed.


We are not responsible for an animal escaping where a gate or access point reasonably needs to be opened to perform the requested service and reasonable care has been taken. 


Customers should advise us beforehand of animals presenting unusual risks.


8. Objects on Lawns and Work Areas


Customers should remove toys, hoses, cables, furniture, pet waste, stones, and other movable objects from work areas before scheduled service.


We will take reasonable care, but we are not responsible for damage caused by concealed, unexpected, or inadequately disclosed objects where reasonable care has been exercised.


9. Weather and Ground Conditions


Landscaping and exterior property services are weather dependent. 


We may postpone, reschedule, modify, or suspend work where conditions make the service unsafe, impractical, or likely to cause unreasonable damage.


Examples include:


- Rain

- Wet or waterlogged ground

- Frost

- Storms

- High winds

- Extreme heat

- Unsafe surfaces


A dry day does not necessarily mean that lawns or soil are suitable for mowing or other work. 


Weather-related rescheduling is not treated as a failure to provide the landscaping service.


10. Service Timing


Appointment times may be approximate unless a specific time has expressly been agreed.


Travel, weather, equipment issues, previous jobs, and other operational circumstances can affect arrival times.


Where a material delay occurs, we will make reasonable efforts to communicate with the customer.


11. Green Waste and Disposal


Green-waste removal is included only where specified in the applicable service or quote.


Additional disposal, landfill, or waste-handling requirements may incur additional charges where agreed or reasonably disclosed.


12. Water and Electricity


Where a service reasonably requires access to ordinary household water or electricity, the customer agrees to provide reasonable access unless alternative arrangements have been agreed beforehand.


13. Existing Property Condition


We take reasonable care when working at customer properties.


Customers should tell us about fragile, damaged, concealed, or unusually valuable property in or around the work area. 


We are not responsible for pre-existing deterioration or defects that become apparent during ordinary service, including deterioration involving fencing, paving, outdoor fittings, vegetation, structures, or other property.


14. Damage


If you believe our work has caused damage, please notify us as soon as reasonably practicable and provide reasonable information allowing us to investigate.


Where we are legally responsible for damage, the appropriate remedy will be determined having regard to applicable New Zealand law and the circumstances. 


Nothing in these Tararua Inc. terms limits liability where doing so would be unlawful.


15. Customer-Supplied Instructions


We may rely on information and instructions provided by the customer. 


The customer is responsible for ensuring they have authority to authorise work at the property.


16. Cancellations and Rescheduling


Customers should provide reasonable notice when cancelling or rescheduling a confirmed service.


Where a cancellation occurs at short notice after labour, travel, equipment, or other resources have been committed, a cancellation or call-out fee may apply if that fee was disclosed or agreed.


Separate subscription, contract, or recurring-service cancellation terms may apply where expressly agreed.


17. Invoices and Payment


Invoices for landscaping services must be paid by the due date stated on the invoice or according to the applicable service agreement.


Available payment methods may vary.


Customers should use the payment information provided on the applicable invoice or authorised payment page.


18. Overdue Accounts


If an account becomes overdue, we may:


- Send payment reminders

- Suspend future services

- Require payment before additional work

- Cancel recurring services where appropriate

- Take reasonable steps to recover the outstanding debt


Where permitted by law and agreed with the customer, reasonable debt-recovery costs may also be recoverable.


19. Recurring and Automatic Payments


Where a customer expressly agrees to recurring or automatic payments, payments may be processed according to the frequency and amount disclosed when the arrangement is established.


Customers are responsible for keeping their payment method current.


Cancellation of an automatic payment does not extinguish amounts already properly due.


20. Complaints


If you are dissatisfied with a service, please contact us promptly. 


We will assess the circumstances and, where appropriate, may inspect the work and provide a remedy consistent with our obligations under applicable New Zealand law.


21. Health and Safety


We may refuse, postpone, or stop work where we reasonably believe conditions present a health or safety risk to our staff, contractors, customers, members of the public, or property.


22. Events Outside Our Reasonable Control


We are not responsible for delay or inability to perform work resulting from circumstances outside our reasonable control, subject to applicable law. 


These may include severe weather, natural disasters, road closures, emergencies, utility failures, significant equipment failures, or other unforeseen events.


23. Changes to These Terms


We may update these Tararua Inc. terms from time to time.


Changes will not retrospectively alter an already accepted fixed agreement unless permitted by that agreement or agreed with the customer.


The current general Terms will be available on our website.


24. New Zealand Law


These Tararua Inc. terms are governed by the laws of New Zealand.
